These Terms and Conditions (the "Terms") form a binding legal agreement between you ("you," "User," or "Customer") and SaferHome AI, LLC, a Florida limited liability company ("SaferHome," "we," "our," or "us"), governing your access to and use of the SaferHome.AI Resiliency Scorecard mobile application, the saferhome.ai website, and all related products, content, reports, and services (collectively, the "Services")

BY CREATING AN ACCOUNT, INSTALLING OR USING THE SERVICES, OR CHECKING THE BOX TO ACCEPT THESE TERMS, YOU AGREE TO BE BOUND BY THESE TERMS, OUR PRIVACY POLICY, AND ALL POSTED LEGAL DISCLAIMERS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

Section 20 contains a BINDING ARBITRATION AGREEMENT and a CLASS ACTION WAIVER that affect your legal rights. Please read it carefully.

1. ELIGIBILITY & ACCOUNT REGISTRATION

You must be at least 18 years of age and legally able to form a binding contract under the laws of the State of Florida and the United States to use the Services. By using the Services, you represent and warrant that you meet these requirements.

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date. You are solely responsible for all activity that occurs under your credentials and for safeguarding your password. You must notify us immediately of any suspected unauthorized access at

We may, in our sole discretion, refuse, suspend, or terminate any account at any time for any lawful reason, including suspected fraud, misrepresentation, or violation of these Terms.

2. DESCRIPTION OF SERVICES

The Services provide a multi-signal property resilience assessment that combines publicly available administrative records, geospatial data, third-party datasets, and user-submitted information to generate a Fortification Score, a Category Ceiling, upgrade recommendations, estimated insurance savings, and related reports for residential properties initially limited to Pinellas County, Florida, or such other jurisdictions as we may designate from time to time.

The Services are an informational and educational tool only. They do not constitute, and should not be relied upon as, professional engineering, structural, construction, code-compliance, real-estate, legal, tax, financial, or insurance advice. The Services are not, and shall not be construed as, an inspection performed by a licensed home inspector or a certification by a licensed engineer.

We may add, modify, suspend, or discontinue any portion of the Services at any time without notice or liability.

3. SUBSCRIPTION TIERS, PRICING & BILLING

The Services are offered in three tiers: (a) Member — free; (b) Customer — a one-time payment of $20.00 USD that unlocks the Home Fortification Report, AI camera verification, and the OIR-B1-1802 readiness package for a single property; and (c) Subscriber — an annual recurring fee of $99.00 USD that adds historical re-certification, regeneration, and ongoing plan updates. Pricing is exclusive of applicable taxes.

Subscriber-tier purchases automatically renew each year at the then-current rate using your stored payment method until cancelled. You may cancel at any time through the platform you used to purchase (Apple App Store, Google Play, or Stripe), and cancellation will take effect at the end of the then-current billing period.

All payments are processed by third-party payment processors. By providing payment information, you authorize us and our processors to charge the applicable fees and any taxes to your selected method.

4. REFUND POLICY

We offer a thirty (30) day refund window from the date of original purchase for the one-time Customer-tier report and for the first annual Subscriber renewal. To request a refund, email [email protected] from the address on file. Refunds for purchases made through Apple App Store or Google Play are subject to those platforms' refund policies and may need to be requested directly through them.

Renewals after the first year are non-refundable except where required by applicable law.

5. USER-SUBMITTED CONTENT & LICENSE

You may submit photographs, videos, documents, addresses, year-built data, intake answers, wind-mitigation forms, proof-of-ownership documents, and other materials (collectively, "User Content"). You represent and warrant that you own or have all rights necessary to submit the User Content and that it is accurate, lawful, and does not infringe any third-party right.

You grant SaferHomeAI a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works from, analyze, and use User Content for the purposes of providing, improving, and securing the Services; training and validating our internal AI verification models on a de-identified basis; preparing reports for you; and complying with legal obligations. This license survives termination only to the extent reasonably necessary for those purposes.

You are solely responsible for the accuracy, truthfulness, and lawfulness of all User Content. Submission of fraudulent, falsified, or misrepresented materials — including doctored photos or forged ownership documents — is a material breach of these Terms and may be reported to insurers, lenders, and law-enforcement authorities.

6. AI CAMERA VERIFICATION — IMPORTANT LIMITATIONS

The Services use artificial intelligence and computer-vision models (including large multimodal models) to analyze submitted photographs and documents in order to estimate whether a hardening mission has been completed. AI verification is probabilistic, not deterministic, and may produce false positives or false negatives.

AI verification within the Services is NOT a licensed home inspection, a wind-mitigation inspection, a building-code certification, or a substitute for the Florida Uniform Mitigation Verification Inspection Form (OIR-B1-1802) signed by a qualified inspector. Insurers and regulators determine, at their sole discretion, what evidence they will accept for premium credits or compliance.

We do not guarantee that any insurer, lender, governmental authority, or third party will accept reports, scores, blueprints, or verification results generated by the Services.

7. PROPERTY OWNERSHIP VERIFICATION

The optional ownership verification feature uses AI document analysis to assess whether an uploaded utility bill, tax bill, insurance declaration, mortgage statement, or recorded deed appears, on its face, to evidence your ownership of the listed property. This feature does not constitute title insurance, a title opinion, or a legal determination of ownership.

Marking a property as "Ownership Verified" within the Services does not bind any third party and does not create any warranty by SaferHomeAI regarding marketable title.

8. PUBLIC DATA SOURCES & THIRD-PARTY SERVICES

The Services integrate data from third-party sources, including the Pinellas County Property Appraiser Office (PCPAO), the Florida Division of Emergency Management evacuation-zone data, FEMA flood data, the Open Elevation API, and others (collectively, "Third-Party Data"). Such data may be incomplete, outdated, or inaccurate. We do not control and are not responsible for Third-Party Data.

Payments are processed by Apple, Google, Stripe, and similar

processors. Communications, hosting, mapping, and analytics are provided by third-party vendors. Your use of those features is subject to the applicable third-party terms and privacy policies, which we encourage you to review.

9. INSURANCE DISCLAIMER

SaferHome is not a licensed insurance producer, agent, broker, adjuster, or carrier and does not sell, broker, or place insurance. References to Florida Statutes §§ 627.0629 and 627.711, mitigation credits, and premium savings are for informational purposes only.

Estimated premiums and savings are derived from publicly available rate filings, zone-based modeling, and industry averages, and are illustrative only. Actual premiums, eligibility for mitigation credits, underwriting decisions, and discounts are determined solely by individual carriers in accordance with their guidelines and applicable law.

10. ACCEPTABLE USE

You agree NOT to: (a) use the Services for any unlawful, fraudulent, or harmful purpose; (b) reverse engineer, decompile,scrape, harvest, or systematically extract content or data from the Services except as permitted by law; (c) resell, sublicense, or commercially redistribute reports, scores, or Blueprints without our prior written consent; (d) submit forged, doctored, or AI-generated synthetic photographs intended to obtain unearned mission credits; (e) interfere with or disrupt the Services, servers, or networks; (f) use the Services to harass, defame, stalk, or violate the privacy of any person; or (g) use the Services in any manner that violates the Florida Computer Abuse and Data Recovery Act (Fla. Stat. § 668.801 et seq.) or the federal Computer Fraud and Abuse Act.

11. INTELLECTUAL PROPERTY

The Services, including all software, source code, models, scoring algorithms, the Fortification Score and Category Ceiling methodologies, report templates, trademarks, logos, and the SaferHome.AI brand, are owned by SaferHomeAI or our licensors and are protected by United States and international copyright, trademark, trade-secret, and other intellectual-

property laws.

Subject to your compliance with these Terms, we grant you a limited, revocable,non-exclusive, non-transferable license to access and use the Services and to download, display, print, and share reports generated for properties you control, solely for your personal, non-commercial purposes.

All rights not expressly granted are reserved.

12. PRIVACY

Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to those practices. If you are a Florida resident, you may have additional rights under the Florida Digital Bill of Rights (Fla. Stat. § 501.701 et seq.).

13. DISCLAIMER OF WARRANTIES

THE SERVICES, INCLUDING ALL REPORTS, SCORES, RECOMMENDATIONS, AND CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, SAFERHOME EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

WITHOUT LIMITATION, SAFERHOME MAKES NO WARRANTY THAT (A) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) RESILIENCE SCORES, CATEGORY CEILINGS, OR INSURANCE-SAVINGS ESTIMATES WILL BE ACCURATE OR PREDICTIVE; (C) THE PROPERTY WILL WITHSTAND ANY PARTICULAR HURRICANE CATEGORY OR WIND SPEED; OR (D) ANY INSURER, LENDER, BUYER, OR GOVERNMENTAL AUTHORITY WILL ACCEPT, RELY ON, OR CREDIT ANY OUTPUT OF THE SERVICES.

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFERHOME, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, PROPERTY DAMAGE, OR PERSONAL INJURY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF SAFERHOME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO SAFERHOME IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. NO EMERGENCY SERVICE

The Services do not provide real-time storm tracking, emergency alerts, evacuation notifications, or life-safety services. In any emergency, dial 9-1-1 and rely on official sources such as the National Hurricane Center, the Florida Division of Emergency Management, and your county emergency-management office.

16. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless SaferHomeAI, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Services; (b) your User Content; (c) your breach of these Terms or any representation made herein; (d) your violation of any law or third-party right; or (e) any submission to an insurer, lender, buyer, or governmental authority that relies on the Services

17. TERMINATION

You may terminate your account at any time by deleting the application and emailing [email protected] to request closure of your account. We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms.

Sections 5 (license grant), 11 – 17, 19 – 22 of these Terms survive termination.

18. GOVERNING LAW & VENUE

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to Section 20, the exclusive venue for any action not subject to arbitration shall be the state or federal courts located in Pinellas County, Florida, and you irrevocably consent to the personal jurisdiction of those courts.

19. BINDING ARBITRATION & CLASS ACTION WAIVER

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services (each, a "Dispute") shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Pinellas County, Florida (or, at your election if you reside outside Florida, in your home county), in the English language, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

YOU AND SAFERHOME EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR CONSOLIDATED ACTION. THE ARBITRATOR MAY AWARD RELIEF ONLY ON AN INDIVIDUAL BASIS.

Notwithstanding the foregoing, either party may bring (a) an individual action in a small-claims court of competent jurisdiction, and (b) an action in court to enjoin infringement or other misuse of intellectual-property rights.

You may opt out of this arbitration agreement by emailing a written opt-out notice to [email protected] within thirty (30) days of first accepting these Terms; the notice must include your full name, account email, and an unambiguous statement of your intent to opt out.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time. The most current version will always be posted in the Services with a revised "Effective Date." Material changes will be communicated to you by in-app notice or email at least fourteen (14) days before they take effect. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of those Terms.

21. MISCELLANEOUS

Entire Agreement. These Terms, together with the Privacy Policy and Legal Disclaimers, constitute the entire agreement between you and SaferHome with respect to the Services and supersede all prior or contemporaneous agreements.

Severability. If any provision is held invalid or unenforceable, the remainder shall continue in full force and effect, and the invalid provision shall be reformed to the minimum extent necessary to render it enforceable.

No Waiver. Failure to enforce any provision shall not constitute a waiver of that or any other provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including hurricanes, floods, fires, pandemics, labor disputes, internet outages, or governmental action.

Notices. Notices to you may be delivered by in-app message, email to your account address, or posting in the Services. Notices to us must be sent to [email protected].
